Question
Regarding the segmental breakdown of type of counterparties in the different columns, some EU countries might have a different classification of clients according to domestic law (e.g. Micro & SME might have a lower threshold of turnover to fall into that category). Can we accept the breakdown according to different local regulations/law or do we have to reclassify that internal segmentation?
Response
Where the guidance provides a clear and unambiguous definition, e.g. based on EU law, it should be applied consistently. Only where no clear reference is provided can these classifications be based on the local regulations/law.
